Dear San Juan Capistrano Neighbor:

Many of you by now may have received the outrageous political mailers that attack me and my integrity. I obviously have the out-of-town developers and other special interests extremely upset for them and my opponents to stoop to such tactics. Sending out these kinds of irrelevant, distorted half-truths, lies and misleading information is the lowest kind of electioneering and has no place in our town. The group funding these mailers has spent over one-half million dollars. They are skirting campaign laws and funneling huge sums of money to help my opponent in a blatant attempt to confuse the voters and distort the facts to serve their own financial interests.

DON'T BE FOOLED! My job specialty is working to fix or turn around troubled companies. These companies usually have lawsuits and debts incurred prior to my arrival.

· Check the dates and you will see most of the allegations are from prior to my employment.
· The personal lawsuit was so ridiculous that it was never even served on me. It was a desperate attempt to muzzle my whistle blowing.

· I saved ISD from bankruptcy, protected jobs and returned the company to profitability (and yes, the taxes were paid!)

· CAUSE simply missed a deadline for filing a form, which has been corrected.
Sometimes I must stand up to those in power and incur their wrath when they stand in the way of doing the right thing. Lawsuits are a favorite tactic for bullies, but are a tactic that obviously does not deter me from doing what is right.

In fact, the developer of Whispering Hills had his attorney call me after 10 p.m. one night at my home to threaten me with lawsuits if I supported the referendum against his project. I do not give up simply because someone threatens a lawsuit or files an unfounded suit intended to shake me up. A formal complaint for libel and campaign law violations has been filed with the Fair Political Practices Commission against those putting out these lies.

I stand by my record and would be happy to defend my history IN PERSON against the people who hide behind these anonymous mailers. Let's be clear. This is all about outside developers and those with special interests using any tactic, no matter how low, to protect their own financial interests.

The questions that should be asked are:

1. Who is funding these political "hit pieces" and why?

2. Why are they willing to spend over $100,000 to distort the facts and attack me to get my opponent elected to the Council?

3. Why are these out-of-town developers and special interests so afraid of someone getting on the Council who has no hidden agenda?

The bottom line question is, "Are we, the residents of San Juan Capistrano, going to let our town be sold out to the highest bidder, and will these unethical tactics be allowed to win?"
Please protect the integrity of our town and send a message back to these special interests.

The Truth About the Lies and Distortions Being Told

1) What is this about CAUSE being suspended by the Secretary of State?

ANSWER - It was a simple paperwork error, now corrected. CAUSE didn't file a form when it was due because the State had a wrong mailing address for the notices.

2) What about the lawsuit naming Mark?

ANSWER - Anyone can file a lawsuit against someone with outrageous claims. This suit was never even served on Mark because it was a bullying tactic to stop Mark from doing the right thing. Did you know that the Whispering Hills developer had his attorney threaten Mark with lawsuits if Mark supported the referendum against his project?

3) What about all those FTC or "cramming" charges?

ANSWER - Mark goes into troubled companies to fix problems. Those issues existed in the company before Mark arrived, and was one of the reasons Mark was brought in.

4) What about the IRS tax lien on ISD Corporation?

ANSWER - This is another example of a problem which existed before Mark was hired. Mark fixed the problems, saved the company, made it profitable, and the tax bill was paid in full.
